Agentic, Robotics, Ambient & Clinical AI: The Copilot Wave Meets the Accountability Gap
The NHS's largest-ever enterprise AI deployment — 505,000 Microsoft Copilot seats — crossed the threshold from pilot to national rollout this week, while the regulatory infrastructure to govern it (and the agentic AI built on top) finally started to take shape. This week, deployment vs. governance
The pattern is now unmistakable: deployment is moving faster than governance, but the gap is closing. The MHRA's AI regulatory sandbox went live for London, the Ambient Voice Technology Supplier Registry hit a new procurement milestone, and the Copilot rollout is forcing trusts to confront the accountability question head-on.

1 Agentic AI
The question is no longer whether AI agents can act — it's whether you can prove what they did, why, and who owns the outcome.
NHS England's 505,000-seat Microsoft Copilot rollout entered its distribution phase this week, with trusts receiving ~2,000 licenses each and full deployment targeted for October 2026. The rollout includes Copilot Studio and Agent 365, Microsoft's governance framework for building, deploying, and monitoring narrow AI agents on top of Copilot.
The 90-organization pilot (30,000 staff) reported 43 minutes of daily admin saved per user — a figure NHS England extrapolates to 1.5 million working hours per month at full scale. Early use cases include FOI requests, complaints processing, helpdesk workflows, and financial analysis.
Agent 365 is not optional window dressing — it's the mechanism NHS England is using to maintain an audit trail for agent actions. The governance question for trusts is now: does your AI governance committee have visibility into Agent 365 logs, and can they trace a specific agent action back to a named owner?
Before deploying any custom agent via Copilot Studio, write down the escalation path: who reviews the agent's output, who signs off on errors, and where the incident gets logged. Test that path with a simulated failure before go-live.
2 Robotics AI
Robotic surgery is now a national priority — but without a national funding or distribution strategy, access remains a function of geography, not clinical need.
The Royal College of Surgeons of England published the first publicly-available national dataset on robotic surgery access, confirming stark regional disparities: London trusts have 28 systems; the Southwest has six; the East of England has 15. The analysis explicitly labels this a "postcode lottery" despite NHS England's 2035 target of robots in 9 of 10 keyhole surgeries.
NHS Shared Business Services is preparing a £150m–£180m framework agreement for surgical robots, consumables, and related services, with contract dates estimated from May 2027 to May 2031. This is the first national-level procurement vehicle for robotics — but it arrives two years after the 10 Year Health Plan's 2026 expansion target.
The RCS England report calls for a national funding and distribution strategy — not just a procurement framework. Without it, trusts reliant on local fundraising will continue to lag behind, and the 2035 target will remain aspirational for large parts of the country.

3 Ambient AI
Ambient scribing is now mainstream. This week the regulator finally drew the line between what counts as a medical device — and what doesn't.
The MHRA, working closely with NHS England, published guidance clarifying how medical device law applies to ambient voice technology (AVT). Tools intended solely for transcription, summarising conversations, drafting letters, or suggesting codes for clinician review are not regulated as medical devices; tools that support diagnosis or treatment, or take automated action without clinician review, are.
NHS England's Chief Digital, Data and Technology Officer confirmed the health service will "now begin rolling out the technology across the NHS safely, consistently and at scale." Manchester University NHS Foundation Trust and Cambridge University Hospitals NHS Foundation Trust both welcomed the clarity as removing a blocker to wider adoption.
Clinicians remain responsible for reviewing and verifying AI-generated transcripts and summaries before they're used in patient care — that responsibility is unchanged by the guidance. NHS boards are separately asked to assure themselves that deployment has clinical oversight, local governance, staff training, and procurement processes in place, and to monitor for any change in a product's functionality that could shift its regulatory status.
Ask any AVT supplier, in writing, which regulatory category their product's functions fall into: pure transcription/summarisation (unregulated) or diagnosis/treatment support and automated action (regulated medical device). If they can't answer clearly, treat that as a red flag before procurement.
4 Clinical AI
Diagnostic AI is moving from retrospective accuracy claims to prospective, real-world evidence — and the MHRA is now providing the infrastructure to generate it.
The MHRA launched its London Region I regulatory sandbox for AI-enabled medical devices on 30 July 2026, inviting manufacturers and NHS trusts to deploy live AI diagnostics under regulatory supervision. The call for expressions of interest remains open until ten devices have been selected and deployed.
The sandbox is the operationalization of the AI Airlock programme, which completed Phase 2 (April 2025–May 2026) with seven case studies and published lessons learned in June 2026. It offers a structured environment for generating NHS-specific safety evidence — the kind of evidence the Articulate Pro study set as the new standard.
The sandbox is designed to accelerate access to innovative AI diagnostics while maintaining regulatory oversight — a direct response to the "evidence gap" that has plagued diagnostic AI rollouts. For trusts, participation offers a pathway to deploy cutting-edge AI with regulatory cover; for manufacturers, it offers a route to generate the NHS-specific evidence required for procurement.
When evaluating a diagnostic AI tool, ask whether the vendor has applied (or plans to apply) for the MHRA AI Airlock sandbox. If not, ask why — and whether they have an alternative pathway to generate NHS-specific prospective safety evidence.
